Who Can File a Wrongful Death Claim in Georgia and Arizona?
Each state has its own laws regarding personal injury and wrongful death claims. The laws differ depending on the state you live in. These are the basic rules for filing a wrongful death claim in any state:
- Arizona: A spouse, child, parent or guardian, or personal representative of the deceased’s estate may file a wrongful death claim. Plaintiffs have two years from the date of death to file a claim. Currently, there are no damage limits on the amount claimants can receive in wrongful death claims in Arizona.
- Georgia: The spouse may file first and must also represent the interests of any minor children. In no case may a spouse receive less than one-third of the total recovery in Georgia, regardless of the number of children. Surviving parents or personal representatives may file a claim if there is no surviving spouse or children. The Georgia statute of limitations is also two years from the date of death.
In Georgia, if there is a criminal case associated with the death, the time to file a wrongful death claim is extended. The two-year timer begins when the criminal case is concluded. Courts can also suspend the deadline for up to five years if the deceased person’s estate has not yet gone through probate. This means that a claim can be filed, in some cases, up to seven years after the date of death. However, at Cruz & Associates, we recommend starting the filing process as soon as possible.
